These terms apply to your use of the Humming website at hummingfork.com (the "Site") and to any order you place with us. Please read them before ordering. By using the Site or placing an order, you agree to these terms.

2. Using the Site
You must be at least 18 years old to place an order. You agree to use the Site lawfully and not to misuse it, interfere with its operation, or attempt to gain unauthorised access to it.
3. Our products
We sell tuning fork sets and related items. We take care to describe and show our products accurately, but images are for illustration and small variations in colour, finish, or tone can occur. Product availability is not guaranteed and we may change or discontinue items at any time.
4. Wellbeing and health disclaimer
Our products are wellbeing instruments. They are not medical devices, and nothing we say about them is medical advice.
Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and they are not a substitute for professional medical, psychological, or therapeutic care. Any statements we make about resonance, breath, or how the body responds describe a sensory and physical experience, not a clinical outcome.
If you have a health condition, are pregnant, have a pacemaker or other medical implant, or have any concern about whether these products are suitable for you, please consult a qualified healthcare professional before use. You use our products at your own discretion.
5. Prices and currency
Prices are shown in the currency you select at checkout and may be displayed inclusive or exclusive of tax depending on your location. We try to keep prices accurate, but if we discover an obvious pricing error on an item you have ordered, we will contact you and you may continue at the correct price or cancel.
For orders shipped outside the United Kingdom, you are responsible for any import duties, customs charges, or local taxes that may apply on arrival.
6. Orders and acceptance
Your order is an offer to buy. A contract between us is formed only when we send you a dispatch confirmation email confirming the goods have been sent — not when you receive your order confirmation. We may decline or cancel an order before dispatch (for example, if an item is out of stock, payment cannot be taken, or a pricing error has occurred), in which case we will refund any payment in full.
7. Payment
Payment is taken at checkout through our payment providers. We do not store your full card details. You confirm that you are authorised to use the payment method you provide.
8. Delivery
We aim to dispatch and deliver within the timeframes set out in our Shipping Policy. Delivery times are estimates and not guaranteed. Risk in the goods passes to you on delivery.
9. Returns, refunds, and cancellation
Our Return & Refund Policy forms part of these terms and explains how to return items and request refunds. Your statutory rights to cancel or to reject faulty goods depend on the country in which you live and are not affected by these terms — see section 14.
10. Intellectual property
All content on the Site — including the Humming name, logo, text, images, and design — is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission.
11. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under applicable law.
Subject to that, our total liability to you for any claim arising from an order is limited to the price you paid for that order, and we are not liable for losses that were not foreseeable or that do not result from our breach.
12. Events outside our control
We are not responsible for delays or failures in performing our obligations caused by events outside our reasonable control, including supply failures, postal or courier disruption, extreme weather, or other circumstances beyond our control.
13. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.
14. Governing law and your local rights
These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction — except that if you are a consumer resident elsewhere, you may also be entitled to bring proceedings in your own country, and you keep the benefit of any mandatory consumer protection rights that apply where you live. Nothing in these terms removes or reduces the statutory consumer rights you hold in your country of residence.
15. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one published on the Site at the time you place it. Please check this page periodically.
16. General
If any part of these terms is found to be unenforceable, the rest will continue to apply. Our failure to enforce any right is not a waiver of it.
